List of 45 Mining Rights & Investment Amount
Rights #1 to #8: Thurain Taung (Famous for Ruby, Sapphire, and Spinel)
"Mining methods such as Open-pit, Lebin and Myaw-dwin and also Loo-dwin and Gwe-dwin are used. Mostly rubies, sapphires and spinels are found at Thurein-Taung area and its hill sides such as alluvial, especially at both sides of the southeastern and northeastern parts of this area. Gemstones are scattered around the hill environs. The cluster of sapphire in weight is 690 carats extracted in Thurein-taung area is very famous.
In the western area of Thurein-taung, highest quality Sapphires and multi - colored sapphires such as bluish-greenish sapphire, color-change sapphire and other precious stones like that cat’s eye painite crystal and baddeleyite crystal are found in this area.
At the top of the southwestern part of the Thurein-taung , ruby, sphene, anatase, baddeleyite, axinite, srilankite, elbaite, schorl, dravite, zircon, other precious gemstones can be extracted in this area.
In the northernmost and bottom of Thurein-taung, highest quality ruby, sapphire and the cluster of ruby crystals can be extracted."

Rights #9 to #13: Baw Lone Gyi (Famous for Ruby, Sapphire, Spinel, Zircon, Quartz, and Painite)
"Open-pit, Myaw-dwin and Lebin mining methods are used in this area. Star rubies are very famous and its quality is great and faceted and cabochon rubies and prismatic ruby and ruby crystal, sapphire and spinel, zircon and quartz are very pretty and painite and other rare gems are found."

Rights #14 to #15: Dat Taw (Famous for Ruby and Spinel)
"This area is located about three kilometers northwest of downtown Mogok.
Dattaw (upper) both primary deposit and fracture-filled deposit and using loo-dwin and Gwe-dwin mining method and tunnel method. This area is very famous in its larger and higher quality of ruby and spinel crystals. Ruby in marble matrix is so beautiful and good luster. Ruby, star ruby, sapphire, diopside, diopside cat’s eye, scapolite and scapolite cat’s eye, spinel, sphene, apatite, aquamarine, danburiye, dravite, elbaite, goshenite, moonstone, orthoclase, quartz, schorl, zircon, edenite and edenite cat’s eye, hornblende, lapis-lazuli, sodalite and hackmanite, cancrinite, marcasite and pyrite and so many precious stones were extracted in this area. Moreover, group of aragonite crystal, zircon crystal, apatite crystal, damburite crystal, sadalite crystal and fibrolite crystal are also found and famous in their great sizes.
Open-pit and loo mining methods are used in this middle site. SLORC Ruby (after the State Law and Order Restoration Council) called as NaWaTa Ruby extracted from this area is very well known. And other precious stones like that tourmaline, topaz, quartz, aquamarine, goshenite, danburite, orthoclase, scapolite, apatite, sodalite-hackmanite, lapis-lazuli, edanite and edanite cat’s eye and moonstone are also found in this middle part. In lower part, the gemstones extracted from elluvial and alluvial deposits. Small-scale open-pit mining method is used. Ruby, sapphire, diopside, diopside cat’s eye, pink scapolite and scapolite cat’s eye, green apatite, danburite, moonstone with golden sheen, zircon, lapis-lazuli, sodalite, hackmanite, and so many precious stones were extracted in this area."

"Manar: It is located north of the Chaung-gyi valley. The small skill open-pit mining method is used in this area. Multi-color sapphires, ruby and spinel are main extracted gemstones and other precious gemstones are also found.
Shwe-daing - Nag-yant-inn: Mining method is gwe-dwin method. High quality ruby, sapphire crystal, spinel, scapolite, sphene and other precious stones can be found in this area.
Thaphanpin: It is situated north of Yebu village. Myaw-dwin, open-pit and lebin mining methods are used in this area. Ruby, sapphire, spinel, moonstone, danburite, quartz, zircon and other precious stones are found in this area. Ruby crystals and spinel twinned crystal are very beautiful and also famous in this area."

Procedures on Gemstone Mining and Manufacturing
The Ministry of Natural Resources and Environmental Conservation (MoNREC), with the consent of the National Unity Government, and exercising the power conferred under Section 69(b), Chapter 69 of the Myanmar Gemstone Law 2019, hereby issues the following procedures for the purpose of implementation of the Early Partnership Programme during the interim period.
Chapter (1)
The Rights of Permit Holders for Gemstone Mining and Production
1. An individual or a company holding the right of mining and production of gems (hereinafter referred to as the ‘permit holder’) that wishes to sublease or transfer the right of production to another party may apply to the Ministry under existing regulations.
2. Where the allotted gemstone block has sustained damages and requires preparation, the permit holder may apply for a specific time period for such preparation before commencing production.
3. Upon completion of the permit term of 3 years, an extension may be applied for a period up to 10 years.
4. The following rights are granted to the permit holder upon receipt of royalties and revenue due on excavated gemstones:
(a) an unrestricted right to carry the same within the country
(b) an unrestricted right to conclude sales in domestic currency (kyats) or in foreign currency within the country
5. The following rights are granted to the investor in relation to processed gemstones, jewellery and gemstone products refined and processed in accordance with prescribed methods:
(a) an unrestricted right to carry the same within the country
(b) an unrestricted right to conclude sales in domestic currency (kyats) or in foreign currency within the country
(c) an unrestricted right for export abroad
6. The permit holder may apply for the use of a temporary building, storage facility and quarters outwith the allocated gemstone block for a specified period for the purposes of mining and production, for storage of raw gemstones and waste, and for storage and maintenance of equipment and machinery, and for land washing and quarrying,
7. The permit holder may apply for tax exemption or relief on the cost of machinery and other raw material required for gemstone production.
8. The permit holder as an investor owning 49 per cent of the production rights shall bear the sole responsibility for the investment pertaining to exploration, equipment, manpower, administration and operation of the allocated block.
9. The permit holder may apply for consideration, specifically for reimbursement on additional investment pertaining to costs associated with production, and for depreciation of equipment and machinery either as a percentage of the profits or as an adjustment in permitted time.
Chapter (2)
The Responsibilities of Permit Holders for Gemstone Mining and Production
10. The permit holder is liable for taxes as specified under the Myanmar Gemstone Law and the provisions of existing laws governing allocation of federal resources.
11. The permit holder must undertake to minimise any adverse effect on the environment and the social and economic life of the local population; and where there are adverse effects or damages, suitable redress and remediation must be provided to restore the status quo ante.
12. Upon commencement of the operations, the permit holder must set aside a fund that is no less than 2 per cent of the total investment towards environmental conservation, health, education, transportation and other developmental needs of the local area to be disbursed in consultation with the relevant federal unit or state government.
13. Upon completion of the excavation, the permit holder must undertake to restore environmental conservation and greening as set out in the relevant environmental conservation policies; and may also apply for the cost to be offset.
14. The permit holder must undertake operations with full transparency and uphold international ethical, social and governance standards.
15. The permit holder must comply with the existing laws such as Myanmar Gem Law, Environmental Conservation Law, and Labour Law throughout the tenure of the permit.
Chapter (3)
Commencement of operations in the Post-Revolution Period
16. A site supervisory committee shall be formed under the supervision of the Ministry to conduct site measurement and inspection; this supervisory committee shall be comprised of the prospective permit holder, other permit holders from adjacent gemstone blocks, and external experts as members.
17. Subject to the inspection of the allotted gemstone block, the site supervisory committee may make adjustments to the parameters of the gemstone block through consultation and coordination should site conditions necessitate such adjustments, depending on environmental and social criteria.
18. The site supervisory committee shall conclude work related to the assigned gemstone block within a period not exceeding four months.
19. The site supervisory committee shall report its findings to the Ministry for review and approval.
20. Upon approval, the prospective permit holder shall remit payments due to the State in a single lump sum.
21. Upon receipt of the payment, a final contractual agreement shall be concluded between the prospective permit holder and the Ministry.
22. Upon conclusion of the final contractual agreement, the Ministry shall undertake a field survey of the allotted gemstone block in accordance with existing legislation and regulations and issue the permit for extraction and production of gemstones along with the map of the gemstone block map.
23. The permit holder may commence operations upon receipt of the official permit and the map of the allotted gemstone block.
Chapter (4)
General Provisions
22. Where the permit holder has failed to comply with the provisions of the existing laws and regulations, the Ministry reserves the right to issue warnings and directions, to suspend rights of extraction and production for a specified period of time or to revoke the permit in entirety.

အခန်း (၁)
ကျောက်မျက်ရတနာ တူးဖော်ထုတ်လုပ်ခွင့်ရရှိသူ၏ အခွင့်အရေးများ
၁။ ကျောက်မျက်ရတနာတူးဖော်ထုတ်လုပ်ခြင်းလုပ်ငန်းအတွက် တူးဖော်ထုတ်လုပ်ခွင့် ရရှိသူ (သို့မဟုတ်) ကုမ္ပဏီ သို့မဟုတ် အဖွဲ့အစည်းသည် တူးဖော်ထုတ်လုပ်ခွင့်အား တဆင့် ငှားရမ်းခြင်း (သို့မဟုတ်) တစ်နည်းနည်းဖြင့် လွှဲပြောင်းလုပ်ကိုင်လိုပါက ဝန်ကြီးဌာနသို့ သတ်မှတ်ပြဋ္ဌာန်းချက်များနှင့်အညီ လျောက်ထားနိုင်သည်။
၂။ တူးဖော်ထုတ်လုပ်မည့်လုပ်ကွက်သည် ပျက်စီးမှုများရှိနေသည့် လုပ်ကွက်ဟောင်းများ ဖြစ်ပါက လုပ်ငန်းမစတင်မီ သီးခြား ပြင်ဆင်ကာလကို လျှောက်ထားရယူခွင့်ရှိသည်။
၃။ ခွင့်ပြုမိန့်သက်တမ်း (၃) နှစ် ကုန်ဆုံးသည့်အခါ၊ ထပ်မံ၍ စုစုပေါင်း (၁၀) နှစ်ပြည့် သည်အထိ တိုးမြှင့် လျှောက်ထားခွင့်ရှိသည်။
၄။ တူးဖော်ရရှိသည့် ကျောက်မျက်ရတနာအရိုင်းကို တွင်းဝခွန်ပေးဆောင်ပြီးပါက အောက်ပါအခွင့်အရေးများကို ရရှိမည် ဖြစ်ပါသည် -
(က) ပြည်တွင်း၌ လွတ်လပ်စွာသယ်ယူခွင့်၊
(ခ) ပြည်တွင်း၌ ကျပ်ငွေဖြင့်ဖြစ်စေ၊ နိုင်ငံခြားငွေဖြင့်ဖြစ်စေ လွတ်လပ်စွာ
ရောင်းချခွင့်၊
၅။ သတ်မှတ်နည်းလမ်းနှင့်အညီ တင်ပြ၍ ပြင်ဆင်ထုတ်လုပ်လိုက်သည့် ကျောက်မျက် ရတနာအချောထည်၊လက်ဝတ်ရတနာနှင့် ကျောက်မျက်ရတနာဖြင့် ပြုလုပ်သော ပစ္စည်းများ နှင့် စပ်လျဉ်း၍ အောက်ပါအခွင့်အရေးများကို ရရှိမည် ဖြစ်ပါသည်-
(က) ပြည်တွင်း၌ လွတ်လပ်စွာ သယ်ယူခွင့်၊
(ခ) ပြည်တွင်း၌ ကျပ်ငွေဖြင့်ဖြစ်စေ၊ နိုင်ငံခြားငွေဖြင့်ဖြစ်စေ လွတ်လပ်စွာ
ရောင်းချခွင့်၊
(ဂ) ပြည်ပသို့ လွတ်လပ်စွာ တင်ပို့ရောင်းချခွင့်၊
၆။ ခွင့်ပြုမိန့်ရရှိသူအနေဖြင့် ကျောက်မျက်ရတနာ တူးဖော်ထုတ်လုပ်ခြင်း အတွက် လိုအပ်သည့် လုပ်ငန်းဆိုင်ရာ ယာယီအဆောက်အအုံ၊ ပစ္စည်းသိုလှောင်ရုံနှင့် တဲတန်းလျားများ ဆောက်လုပ်ရေး အတွက်လည်းကောင်း၊ ထုတ်လုပ်ပြီး ကျောက်ရိုင်းများ၊ ဖြုန်းများနှင့် ယာဉ်စက်ယန္တရားများ ထားရှိရေးအတွက်လည်းကောင်း၊ မြေစာဆေးကြောရေး၊ ကျောက်ထု ခွဲရေး နှင့် မြေစာပစ်ရေးတို့အတွက်လည်းကောင်း တူးဖော်ထုတ်လုပ်ခွင့်ရရှိသော လုပ်ကွက် ပြင်ပရှိ လုပ်ငန်းသုံးနေရာတစ်ခုခုကို သတ်မှတ်ထားသောကာလအတွင်း အသုံးပြုနိုင်ရန် အလို့ငှာ တင်ပြ လျှောက်ထားရယူခွင့်ရှိသည်။
၇။ တူးဖော်ထုတ်လုပ်ခွင့်ရရှိသူအနေဖြင့် ထုတ်လုပ်မှုနှင့်ဆိုင်သော စက်ပစ္စည်းကိရိယာ များနှင့် လိုအပ်သောကုန်ကြမ်းပစ္စည်းများကို အကောက်ခွန်ကင်းလွတ်ခွင့် (သို့မဟုတ်) သက်သာခွင့်ဖြင့် တင်သွင်းရန်လျှောက်ထားနိုင်ခွင့်ရှိသည်။
၈။ တူးဖော်ထုတ်လုပ်ခွင့်၏ ၄၉ ရာခိုင်နှုန်းကိုရရှိထားသည့် ရင်းနှီးမြုပ်နှံသူ သို့မဟုတ် တူးဖော် ထုတ်လုပ်ခွင့်ရရှိသူအနေဖြင့် တူးဖော်မှု့များနှင့်စပ်လျဉ်းသည့် ရှာဖွေမှု့လုပ်ငန်းစဉ်များ၊ လိုအပ်သည့် ပစ္စည်းကိရိယာများ၊ လူအင်အား၊ စီမံခန့်ခွဲရေးနှင့် အခြားသောလုပ်ငန်း အကောင် အထည်ဖော်မှု လုပ်ငန်းစဉ်များအတွက် ၁၀၀ ရာခိုင်နှုန်း စိုက်ထုတ်ရင်းနှီး မြုပ်နှံရန် တာဝန်ရှိ ပါသည်။
၉။ ရင်းနှီးမြုပ်နှံမှုကာလတလျှောက်လုံး ထုတ်လုပ်မှု ကုန်ကျစရိတ်၊ စက်ယန္တရားဆိုင်ရာ တန်ဖိုးလျော့ကျမှု စသည်များနှင့် စပ်လျဉ်း၍ ထုတ်လုပ်ခွင့်ရရှိသူ၏ ထပ်မံ ရင်းနှီးမြုပ်နှံရမှု အပေါ် အကျိုးအမြတ်၏ ရာခိုင်နှုန်းတရပ် အရသော်လည်းကောင်း၊ အချိန်ကာလအလိုက် လည်းကောင်း ညှိနှိုင်းစဉ်းစားအတည်ပြုသွားမည်ဖြစ်သည်။
အခန်း (၂)
တူးဖော်ထုတ်လုပ်ခွင့်ရရှိသူ လိုက်နာရမည့် တာဝန်နှင့် ဝတ္တရားများ
၁၀။ မြန်မာ့ကျောက်မျက်ရတနာဥပဒေပါ တွင်းဝခွန်အပါအဝင် သက်ဆိုင်ရာ ဖက်ဒရယ် သယံဇာတခွဲဝေခြင်းနှင့် စပ်လျဉ်းသော တည်ဆဲ အခွန်ဆိုင်ရာ ဥပဒေပြဋ္ဌာန်းချက်များနှင့် အညီ ထိုက်သင့်သည့်အခွန်များပေးဆောင်ရမည်။
၁၁။ နိုင်ငံတော်၏ တည်ဆဲဥပဒေများနှင့်အညီ ပတ်ဝန်းကျင်ထိခိုက်မှု အနည်းဆုံးဖြစ်စေ ရန်နှင့် ဒေသခံပြည်သူလူထူ၏ လူမှုစီးပွားဘဝ ထိခိုက်မှုအနည်းဆုံးဖြစ်စေရန် အလေးထား ဆောင်ရွက်ရမည်။ ထိခိုက်မှုများ ဖြစ်ပေါ်လာသည့် အခြေအနေများတွင် မူလအနေ အထား ပြန်လည်ရရှိနိုင်ရေးအတွက် သင့်လျော်သည့် ကုစားမှုများကို ဆောင်ရွက်ပေးရမည်။
၁၂။ လုပ်ငန်းဆောင်ရွက်ရာဒေသ၏ သဘာဝပတ်ဝန်းကျင်ထိန်းသိမ်းရေး၊ ကျန်းမာရေး၊ ပညာရေး၊ လမ်းပန်းဆက်သွယ်ရေးနှင့် အခြားဖွံ့ဖြိုးရေး လုပ်ငန်းများအတွက် ရင်းနှီးမြှုပ်နှံ မှု၏ ၂ ရာခိုင်နှုန်းထက် မနည်းသော ရန်ပုံငွေတရပ်အား လုပ်ငန်းစတင်သည်နှင့် တပြိုင်နက် တည်း သက်ဆိုင်ရာဖက်ဒရယ်ယူနစ်/ ပြည်နယ်အစိုးရများနှင့် ညှိနှိုင်း၍ ထူထောင်ထားရှိ ဆောင်ရွက်ရမည်။
၁၃။ တူးဖော်ထုတ်လုပ်ခြင်းလုပ်ငန်း ပိတ်သိမ်းသည့်အခါ သဘာဝပတ်ဝန်းကျင် ထိန်းသိမ်း ရေး လုပ်ငန်းများ၊ စိမ်းလန်းစိုပြေရေး လုပ်ငန်းများကို သတ်မှတ်ချက်နှင့်အညီ ဆောင်ရွက် ပေးရမည်။ ယင်းသို့ဆောင်ရွက်ခြင်းကို ထုတ်လုပ်မှုကုန်ကျစရိတ် တစိတ်တပိုင်း အဖြစ် သတ်မှတ်နိုင်ရေး တင်ပြညှိနှိုင်းနိုင်သည်။
၁၄။ ပွင့်လင်းမြင်သာမှုဖော်ဆောင်ရေး လုပ်ငန်းစဉ်အပါအဝင် နိုင်ငံတကာအသိအမှတ်ပြု စံချိန်စံညွှန်းများနှင့်ကိုက်ညီမှုရှိစေရေးကို ဆောင်ရွက်ရမည်။
၁၅။ ကျောက်မျက်ရတနာ တူးဖော်ထုတ်လုပ်ခြင်းလုပ်ငန်းအတွက် တူးဖော်ထုတ်လုပ်ခွင့် ရရှိသူ (သို့မဟုတ်) ကုမ္ပဏီသည် တည်ဆဲ မြန်မာ့ကျောက်မျက် ရတနာဥပဒေပါ ပြဋ္ဌာန်းချက် များ၊ ပတ်ဝန်းကျင် ထိန်းသိမ်းရေးဥပဒေပြဋ္ဌာန်းချက်များ၊ အလုပ်သမားများနှင့် စပ်လျဉ်းသည့် ပြည်တွင်း တည်ဆဲဥပဒေပြဋ္ဌာန်းချက်များအားလုံးကိုလိုက်နာရမည်။

တော်လှန်ရေးကာလ ပြီးဆုံးချိန်၌ လုပ်ငန်းစတင်ဆောင်ရွက်ခြင်း
၁၆။ လုပ်ကွက်ကွင်းဆင်းတိုင်းတာရေးနှင့် လုပ်ကွက်အခြေအနေစစ်ဆေးရေး လုပ်ငန်းများ ဆောင်ရွက်ရန်အတွက် လုပ်ကွက် တာဝန်ခံအဖွဲ့ကို သက်ဆိုင်ရာဝန်ကြီးဌာန၏ ကြီးကြပ် ကွပ်ကဲမှုဖြင့် ဖွဲ့စည်းရမည်ဖြစ်ပြီး၊ အဆိုပါ တာဝန်ခံအဖွဲ့တွင် ခွင့်ပြုမိန့်ရ လုပ်ငန်းရှင်၊ ဆက်စပ် လုပ်ကွက်များမှ လုပ်ငန်းရှင်များနှင့် ပြင်ပပညာရှင်များကို အဖွဲ့ဝင်များအဖြစ် ထည့်သွင်းရမည်။
၁၇။ လျာထားလုပ်ကွက်များအား ကွင်းဆင်းတိုင်းတာရာတွင် လိုအပ်ပါက မြေပြင်အခြေ အနေနှင့် ကိုက်ညီမှုရှိစေရန် တာဝန်ခံအဖွဲ့အတွင်းဆွေးနွေးညှိနှိုင်း၍ လုပ်ကွက်များ၏ နယ်နိ မိတ် အကျယ်အဝန်းကို ပြင်ဆင်သတ်မှတ်နိုင်သည်။
၁၈။ လုပ်ကွက်တာဝန်ခံအဖွဲ့သည် လုပ်ငန်းများကို သတ်မှတ်အချိန်ကာလ (၄) လ အတွင်း ပြီးစီးအောင် ညှိနှိုင်းဆောင်ရွက်ရမည်။
၁၉။ လုပ်ကွက်တာဝန်ခံအဖွဲ့သည် လုပ်ငန်းများဆောင်ရွက်ပြီး တွေ့ရှိချက်များကို ဝန်ကြီး ဌာနသို့ ပြန်လည်တင်ပြ၍ အတည်ပြုချက်ရယူရမည်။
၂၀။ ထို့နောက် တူးဖော်ထုတ်လုပ်ခွင့်ရရှိသူမှ နိုင်ငံတော်အား ပေးသွင်းရန်ကျန်ရှိသည့် ငွေပမာဏကို တလုံးတခဲတည်း အကြေပေးသွင်းရမည်။
၂၁။ ငွေအကြေပေးသွင်းပြီးပါက တူးဖော်ရေးလုပ်ငန်းများ ဆောင်ရွက်နိုင်ရေးအတွက် ဝန်ကြီးဌာနနှင့် စာချုပ်ထပ်မံ ချုပ်ဆိုရမည် ဖြစ်ပါသည်။
၂၂။ ထိုသို့ စာချုပ်ချုပ်ဆိုပြီးနောက်တွင် ဝန်ကြီးဌာနအနေဖြင့် သက်ဆိုင်ရာ ဥပဒေနှင့်အညီ ကွင်းဆင်းတိုင်းတာပြီးနောက် ကျောက်မျက်ရတနာ လုပ်ကွက်တူးဖော်ထုတ် လုပ်ခွင့်နှင့် လုပ်ကွက်မြေပုံ ထုတ်ပေးရမည်။
၂၃။ ခွင့်ပြုမိန့်ရလုပ်ငန်းရှင်သည် လုပ်ကွက်တူးဖော်ထုတ်လုပ်ခွင့်နှင့် လုပ်ကွက်မြေပုံ လက်ဝယ်ရရှိချိန်မှစ၍ မိမိတူးဖော်လုပ်ကိုင်ခွင့်ရလုပ်ကွက်တွင် လုပ်ငန်းများစတင် ဆောင်ရွက်ခွင့်ရှိမည်။။

အထွေထွေပြဋ္ဌာန်းချက်များ
၂၄။ တူးဖော်ထုတ်လုပ်ခွင့်ရရှိသူသည် သက်ဆိုင်ရာ တည်ဆဲဥပဒေ ပြဋ္ဌာန်းချက်များနှင့် ဝန်ကြီး ဌာနမှ ထုတ်ပြန်သည့် အမိန့်ညွှန်ကြားချက်များကို လိုက်နာမှုမရှိပါက ဝန်ကြီးဌာန၏ ဆုံးဖြတ်ချက်နှင့် အညီ သတိပေးခံရခြင်း၊ ပြဌာန်းညွှန်ကြားချက်များ နှင့်အညီ ပြန်လည် ပြင်ဆင်ရန် တူးဖော်ထုတ်လုပ်ခွင့်ကို ကာလတခု ရပ်ဆိုင်းခံရခြင်း (သို့မဟုတ်) ရုတ်သိမ်း ခံရခြင်း စသည့် အရေးယူမှုများခံရနိုင်သည်။
